YOU CONFER AGENCY AUTHORITY UPON ANY INDIVIDUAL WHO CLICKS THE "I AGREE" BUTTON OR SIGNIFIES ACCEPTANCE OF THESE TERMS AND CONDITIONS ON YOUR BEHALF.
ARBITRATION NOTICE: UNLESS YOU TIMELY OPT-OUT OF ARBITRATION IN ACCORDANCE WITH THESE TERMS AND CONDITIONS, YOU AGREE THAT DISPUTES BETWEEN YOU AND US OR YOU AND THE MEDICAL GROUPS OR PROVIDERS ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS OR THE SERVICE WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHTS TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION, AS FURTHER SET FORTH BELOW. WE EXPLAIN SOME EXCEPTIONS AND HOW YOU CAN OPT OUT OF ARBITRATION BELOW.

These Terms and Conditions govern your access to and use of this website and other related websites and mobile applications with links to these Terms and Conditions (collectively the “Platform”), owned and controlled by GF Health Services, as well as its subsidiaries and affiliates, and/or its contracted medical practice entities (collectively “Geviti,” “we”, “us”, “our”). By accessing or using Geviti, and part thereof, including our content (”Content”), you acknowledge that you have read, understood, and agree to be bound by these terms. These Terms and Conditions are subject to change and it is your responsibility to review them periodically.
Geviti provides practice management and technological support for medical practices, medical groups, and/or independent providers, allowing their patients to receive care from licensed medical professionals ("Providers”), including, but is not limited to, medical treatment provided through telehealth modalities. All medical services made available through the platform are provided by a group medical practices and Providers (”the Medical Group”). Any products or services provided through the Platform or otherwise by Geviti, and any affiliated website, software or application owned or operated by Geviti (collectively, including the Platform and the Content, the “Service”) are governed by these Terms and Conditions (“Terms and Conditions” or “Agreement”).
You agree that by accessing the Platform, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Platform and you must discontinue use immediately.
Review these Terms and Conditions with attention prior to utilizing our Platform and/or the Services. By signing up for, accessing, or utilizing the Platform or Service, you consent to adhere to these Terms and Conditions along with any additional terms and policies presented on the Platform or within the Service. YOU ARE PROHIBITED FROM ACCESSING OR UTILIZING THE PLATFORM AND/OR SERVICES OR AGREEING TO THESE TERMS OF SERVICE IF YOU HAVE NOT REACHED THE AGE OF MAJORITY IN YOUR PLACE OF RESIDENCE. IF YOU DISAGREE WITH ANY PART OF THESE TERMS AND CONDITIONS, YOU SHOULD REFRAIN FROM ACCESSING AND/OR UTILIZING THE SERVICES AND PLATFORM. IN ACCESSING OR UTILIZING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE COMPREHENDED THESE TERMS AND CONDITIONS, AND YOU CONSENT, AS A PREREQUISITE FOR USING THE SERVICES, TO BE LEGALLY BOUND BY THESE TERMS AND OUR PRIVACY POLICY (COLLECTIVELY REFERRED TO AS “THE TERMS”). IF YOU ARE INELIGIBLE OR DO NOT CONSENT TO THESE TERMS, THEN YOU ARE NOT PERMITTED TO USE THE PLATFORM OR SERVICES. YOUR ENGAGEMENT WITH THE PLATFORM AND SERVICES ESTABLISHES A MUTUAL AGREEMENT BETWEEN US AND YOU TO COMPLY WITH THESE TERMS.
Geviti does not give medical advise nor provide medical care. Geviti may make available to individuals who register as members of the Platform (“Member”) certain products and Services sold or offered by us or by third-party Medical Groups, Providers, Pharmacies, or other vendors. Our Platform may make available to Members certain Services that may include prescription fulfillment services offered by the following pharmacies: Strive Compounding Pharmacy headquartered in Gilbert, AZ at 1275 E Baseline Rd #104, Gilbert, AZ 85233 (the “Pharmacies”). Strive Compounding Pharmacy can be reached at 480-626-4366. The Platform may provide access to laboratory services from Labcorp Corporation of America Holdings headquartered in Burlington, NC (the “Labs”). The Platform may make available professional medical Services from Medical Groups and/or Providers contracted with Geviti. By accepting this Agreement, you acknowledge and agree that any services you receive from the Labs, Pharmacies, Medical Groups or Providers through the Platform are also subject to this Agreement, and that the Labs, Pharmacies, Providers, and Medical Groups are third party beneficiaries of this Agreement.
We do not control or interfere with the practice of medicine by any Providers, each of whom is solely responsible for directing the medical care, and/or treatment they provide to Subscribers. By accepting this Agreement, you acknowledge and agree that Geviti is not a healthcare provider and that by using the Services made available as a Geviti Member, you are not entering into a doctor-patient or other health care provider-patient relationship with Geviti. By using the Services, you may, however, be entering into a doctor-patient or other health care provider-patient relationship with the Medical Group and/or one or more Providers. Further, we do not control or interfere with any professional services provided by the Labs and Pharmacies, each of which is solely responsible for their provision of professional services rendered.
Interactions with the Providers through the Platform are not intended to take the place of a relationship with a regular health care practitioner or primary care physician. Neither Geviti, nor any of its subsidiaries or affiliates or any third party who may promote the Platform or Services shall be liable for any professional advice obtained from a Provider, nor any Content or information obtained on the Platform. You acknowledge that your reliance on any Providers or information delivered by the Providers is solely at your own risk and you assume full responsibility for all risks associated herewith.
By accepting this Agreement, you acknowledge and agree that the Providers may send you messages, reports, and emails via the Platform regarding your diagnosis and/or treatment. You understand and agree that Geviti is not responsible for the security or privacy of communications services you use to receive the aforementioned messages, reports, and emails sent via the Platform. You further understand and agree that it is your sole responsibility to monitor and respond to these messages, reports, and emails and that neither Geviti nor the Provider will be responsible in any way and you will not hold Geviti or any Provider liable for any loss, injury, or claims of any kind resulting from your failure to read or respond to these messages or for your failure to comply with any treatment recommendations or instructions from the Provider(s).
While you are not establishing a doctor-patient or other health care provider-patient relationship with Geviti, by using the Platform, you are establishing a direct customer relationship with Geviti to use the Services, including the purchase of any non-prescription products or non-medical services sold directly to you by Geviti. In connection with such relationship, you may provide to us, or cause to be provided to us on your behalf, personal information, including health information, that is subject to use by us in accordance with our Privacy Policy. Please refer to the “Data Privacy and Security” section below for additional information.
Additionally, Geviti provides the following Services: (i) allows users to purchase test kits (“Test Kits”) from the Platform, for themselves or for others; (ii) (1) register Test Kits, whether purchased by or given to you as a gift, through the Platform or Services; and (2) allows users to view and track certain User Data (defined below) obtained from the registered Test Kits; (iii) allows users to purchase supplements or other non-prescription products. Geviti includes the foregoing services herein collectively as part of the Service. Any recommendations regarding medical information or products, such as supplements or potential treatments options, are provided for information purposes only. It is important to note that the Services provided by Geviti are not medical advice. Medical advice is only offered by Providers.
Geviti and the Medical Groups are not enrolled with, and are not participating providers with, any federal or state healthcare programs (i.e., Medicare, Medicaid) for the provision of any health care or mental health services or supplies and, as such, neither you nor Geviti or the Medical Groups may receive payment from such programs for the services or products provided to you by Geviti or the Medical Groups. Further, to the extent that any of the Labs, Pharmacies, or Providers may be enrolled in federal or state healthcare programs, the means through which the services and products are provided or made accessible through the Service typically precludes such services and products from being covered benefits under these programs. By choosing to use Geviti, you are specifically choosing to obtain products and services on a cash basis outside of any federal or state healthcare program. Thus, you are solely responsible for the costs of any service or product provided to you.
By agreeing to use the Service, you acknowledge and agree that (1) you are explicitly choosing to obtain products and services on a cash basis outside of any federal or state healthcare program and you have sole financial responsibility for all services or products provided to you by or through the Service; and (2) neither you nor Geviti, the Labs, the Pharmacies, the Medical Groups, nor the Providers will submit a claim for reimbursement to any federal or state healthcare program for the costs of the services and products provided to you through the Service.
Geviti uses a subscription-based model for its membership, granting Members access to certain products and services sold or offered by us or by third-party Medical Groups, Providers, Pharmacies, or other vendors (the “Membership”). As a Member, you agree to be responsible for the periodic payments that are associated with your Membership. If you purchase a Membership, your subscription is continuous and will be automatically renewed at the end of the applicable subscription period, unless you cancel your Membership before the end of the then-current subscription period. If you cancel your Membership, your account will automatically close at the end of your current billing period. Geviti may change the price for your Membership, from time to time and will communicate any price changes to you in advance and, if applicable, how to accept those changes. Price changes will take effect at the start of the next subscription period following the date of the price change. Subject to applicable law, you accept the new price by continuing to use the Services after the price change takes effect. If you do not agree with a price change, you have the right to reject the change by unsubscribing from the Membership prior to the price change going into effect.
Certain products and services available for purchase through the Platform require that you purchase the product and/or service on an automatically renewing subscription basis. For subscription-based products and services, your payment device will be automatically charged at regular intervals as described for that product or service until you cancel your subscription. You authorize Geviti and its agents to charge your chosen payment method (your “Payment Method”) for the Services provided to you. Your first renewal may be charged early to prevent any discontinuity in treatment. Your subsequent shipments may be charged and shipped up to two (2) days early to accommodate holidays or for other operational reasons to support continuity of treatment. We and/or the Providers may, but are not required to, perform outreach to you from time to time via the Platform to request updates to your information and to facilitate ongoing subscriptions. You may cancel a subscription at any time by emailing support@gogeviti.com and directly requesting a cancellation, or through your online account. Cancellation will take effect at the end of the current subscription period. Your subscription will automatically renew for another subscription period unless you cancel at least two (2) days before the applicable renewal processing date of your subscription. We do not offer refunds for partially used subscription periods, although we may provide refunds on a case-by-case basis in our sole and absolute discretion. We may also offer you the ability to pause your subscription for a specified period of time. If you do not cancel before the end of the pause period, charging to your payment device will resume automatically. We may change our subscription plans and prices from time to time; however, we will provide you advance notice of any price changes or changes to your subscription plans.
In order to simplify the user experience through the Service, you will only see and be required to pay a single “total” subscription price. However, if a subscription product you purchase required a consultation with a Provider, or includes a prescription product that you fill through one of the Pharmacies then the total price you pay includes the amounts charged for use of the Service, as well as amounts charged by the Pharmacy for the prescription drug and the amount charged by the Medical Group for the services of the Provider, as applicable, which amounts are collected on behalf of and paid to the Pharmacies and Medical Groups, respectively.
Certain products require a valid prescription by a licensed healthcare provider. You will not be able to obtain a prescription unless you have completed a consultation with one of the Providers, the Provider has determined the prescription product is appropriate for you and the Provider has written a prescription.
If you complete a consultation with a Provider and fill a prescription through one of the Pharmacies, the prescription product is shipped to you by the applicable Pharmacy and the costs associated with the prescription are included in the total charged to you by the Service as described in the “Subscription Products” section above. If you fill a prescription with a pharmacy other than the Pharmacies, the Service will send the prescription to your selected pharmacy, but you will be responsible for picking up or otherwise obtaining the prescription product and paying the pharmacy directly for the cost of the prescription product.
Prescription products available through the Platform are “Third-Party Goods and Services” as described in the Third-Party Goods and Services section of this Agreement.
Geviti is not responsible for any delays or errors caused by these third-party pharmacies nor shipping carriers. For verification of pharmacy credentials or standards, users are advised to contact the respective pharmacy directly.
Geviti collaborates with mobile phlebotomy service providers for at-home blood testing. Geviti is not liable for any issues arising from these services. Users are advised to verify the credentials and standards of these providers and direct any concerns or issues to the respective service provider. When you register an account with Geviti, you agree to provide accurate, current, and complete information and to update this information to keep it accurate. You are responsible for all activities that occur under your account. You must safeguard the confidentiality of your account information. Geviti reserves the right to suspend or terminate accounts that are used in a manner that is deceptive, fraudulent, or violates these Terms.
In addition, you agree to provide current, complete and accurate purchase and account information for all purchases. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You commit to using Geviti's Platform and Services for lawful purposes only and in a manner that does not infringe on the rights of, restrict, or inhibit anyone else's use and enjoyment of Geviti. Prohibited activities include harassing or causing distress or inconvenience to any other user or provider, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within Geviti.
We reserve the right to refuse service to anyone for any reason at any time. This service is not appropriate for all patients or conditions.
You expressly consent to receiving telehealth services via Geviti or partnered Providers or the Medical Group(s), acknowledging the unique characteristics of these services. You understand the limitations and agree to assume the risks associated with telehealth, including the potential for incomplete medical information and technical difficulties. You understand that Geviti does not make available services for in-person care.
To protect the confidentiality of my health information, you agree to undertake my Telehealth consultation in a private location, and you understand that your Telehealth provider will similarly be in a private location.
In an emergent situation, I understand that the responsibility of my Telehealth provider may be to direct me to emergency medical services, such as an emergency room.
All content, trademarks, logos, and service marks displayed on Geviti are owned by or licensed to GF Health Services and are protected by copyright and other intellectual property laws. Your use of Geviti does not grant you ownership of any content, data, or materials you may access on or through the platform.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Geviti service or products, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
Our Privacy Policy, as part of these Terms, outlines how we collect, use, protect, and disclose your information. We comply with applicable data protection laws and strive to use industry-standard security measures to protect your information.
You acknowledge that you are using the Platform, the Products, and the Services at your own risk. The Platform, the Products, and the Services are provided "as is," and to the full extent permitted by applicable law, Geviti, its affiliates and its third party service providers hereby expressly disclaim any and all warranties, express and implied, including, without limitation, any warranties of accuracy, completeness or reliability, title, noninfringement, merchantability or fitness for a particular purpose, or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form. Geviti, its affiliates, and its third-party service providers do not represent or warrant that access to the Platform and their Services will be uninterrupted or that there will be no failures, errors or omissions, or loss or security breach of transmitted information, or that no viruses will be transmitted through access to or use of the Platform
Geviti, its affiliates, and its third party service providers shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages arising out of this Agreement, the provision of Services hereunder, the sale or purchase of any merchandise ordered through the Site, your access to or inability to access the Platform, Products, or Services, including for viruses alleged to have been obtained from the Services, your use of or reliance on the Services, the Platform information or materials available through third party sites linked to the Site, regardless of the type of claim or the nature of the cause of action, even if advised of the possibility of such damages. Some states do not allow the exclusion of implied warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above exclusions or limitations may not apply to you. You may also have other rights that vary from state to state.
You hereby agree to release Geviti, its affiliates and third-party service providers, and each of their respective directors, officers, employees, and agents from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed ("Claims"), arising out of or in any way connected with your use of the Site and Applications and their Services. If you are a California resident, you waive California Civil Code Section 1542, which states, in part: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
Geviti makes no representation that the Platform Information, the Services or Products offered through the Platform are appropriate, available or legal in any particular location. Those who choose to access the Platform and the Services and Products offered through the Platform do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
You agree to indemnify, defend, and hold harmless Geviti, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or any activity related to your account by you or any other person accessing the service using your account.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, subject to the exclusive jurisdiction of the U.S. courts. This agreement is governed by the laws of the state of Arizona.
California residents are entitled to specific rights under the California Consumer Privacy Act (CCPA). This includes the right to request access to certain information and the right to request deletion of their personal information.

This Agreement is personal to you. You will not assign or otherwise transfer any of your rights, or delegate, subcontract, or otherwise transfer any of your obligations or performance, under this Agreement. Any attempt to assign, delegate, or transfer in violation of this paragraph is void. Geviti may freely assign or otherwise transfer all or any of its rights, or delegate or otherwise transfer all or any of its obligations or performance, under this Agreement. This Agreement is binding upon and inures to the benefit of the parties and their respective permitted successors and assigns.
If any provision of this Agreement is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of this Agreement will continue in full force and effect. This Agreement contains the entire agreement between you and Geviti and supersedes any oral or written statements made by or to you. This Agreement may not be modified except by a written agreement that is signed by an authorized representative of Geviti. Information on providers using the Platform can be founder here.
